As Salaamu Alaikum: When a person has to make expiation for not fasting by feeding one poor person for each day not fasted, does that poor person have to be a Muslim. And if it does have to be a Muslim, what if you can't find a poor Muslim to feed. Jazak Allahu Khair
Answer: Yes it is obligatory to feed a poor muslim to make expiation. This is mentioned by Imaam Shaafai, Imaam Malik, Imaam Ibraheem, ElHasan, and others from the people of knowledge. As it cannot free except the muslim slave, it cannot be fed except the poor muslim.
In regard to your saying that you cannot find a poor muslim, this is not true. The muslim countries are full of poor. Being poor is not being lesser. Many, or some of the prophet's (sallallahu alaihee wa salaam) companions (radi Allahu anhuma) were poor and Allaah honored them and uplifted them. Being upright is what matters. The muslims in their land are poor. If you cannot find in your town send to someone you know in another land.
The expiation unto Kafir is invalid.
